Howd & Ludorf, LLC Wins Defense Verdict in Waterbury JD

Howd & Ludorf LLC Attorney Bryan Haas recently won a defense verdict in negligence case tried before a jury in Waterbury, Connecticut. Plaintiff slipped and fell on ice at a rental property owned by Defendant Joseph Musamano,represented by Attorney Haas.  The plaintiff, a pizza deliveryman for his son's pizza restaurant, claimed the ice on the sidewalk coupled with the lack of lights on the side of the defendant's house created a dangerous and defective condition.

The plaintiff claimed injuries to his head, back, neck, and tailbone as a result of the fall down.  During closing arguments, Attorney Haas argued that the Defendant/landlord's regular visits to the property were what any reasonable landlord would do, and that he was not required to stand on the property twenty-four hours a day, seven days a week waiting for ice to form. 

Regarding the lights on the side of the house, the argument was simple: the front steps, driveway, and rear steps were illuminated at night, and  there is no standard of care that requires artificial illumination in the side yard.  The jury agreed, and returned a defendant's verdict after less than two hours of deliberation.  Cianciolo v.
