HOWD & LUDORF, LLC WINS BREACH OF CONTRACT JURY TRIAL
Howd & Ludorf, LLC Partner, Kristan M. Maccini, has successfully defended Dryfoos Environmental Consulting, LLC before a civil jury in the Hartford Judicial District. In Bralite v. Dryfoos Environmental Consulting, LLC, plaintiff claimed that Dryfoos breached its contract to conduct a Phase I Environmental Site Assessment when it failed to discover on Plaintiff’s property a buried petroleum tank that had been out of use for decades, resulting in significant monetary loss to Bralite. Attorney Maccini introduced the national standards governing such assessments, and asserted that the Dryfoos Environmental Site Assessment was performed diligently and in conformance with such standards. She argued to the jury that the subject petroleum tank was not findable in a Phase I Environmental Site Assessment; therefore, the Bralite/Dryfoos contract was not breached. After two days of deliberations a six-person jury unanimously agreed, and a verdict entered for Defendant Dryfoos on all counts.
